1. Art submission and pre-payment does not automatically create a contract for art job production. Submitted art jobs are subject to our evaluation. If any art job is above our regular published rates, or we cancel a job (see item #8, below), we will cancel/void your Paypal/credit card payment and send you a written quote for the job (which you can then accept) or send you a reason why we cannot produce the job. Your finished art will remain available for a maximum of 3 months. Only written instructions and approvals are accepted. Oral statements by the staff of FIXLOGO PH and our clients are not accepted or considered binding. 2. By submitting art to us, the user and purchaser assumes all responsibility and potential liability regarding trademark, copyright, intellectual and other laws relating to the art. 3. We are not responsible for art errors of any kind (see item #4, below). We are not responsible for art that is not available within the allotted time period or consequences that might arise. Due to the large variety of fonts, we reserve the right to duplicate your text by drawing it rather than typesetting. We will reproduce your text so it looks the same as the original. We suggest and urge you obtain a proof prior to producing any products. 4. We will correct any art errors that are our fault at no charge. We must be given the opportunity to correct any of our errors as we will not refund/credit the cost of the job. We must be notified in writing of any errors within 10 days of our posting your finished art for download or email. Any notifications of errors after this period will be considered a new job and we will charge for corrections. 5. Any and all information (NOT including logos or art) submitted by emails, faxes or any other source including comments, ideas, information, opinions, messages submitted to www.fixlogo.com and related websites and FIXLOGO PH become the exclusive possession of FIXLOGO PH. For that reason, FIXLOGO PH advises against your providing any information, especially confidential knowledge or suggestions. By providing any information establishes a transfer of all rights to FIXLOGO PH without restriction or compensation to you. This does not include the transfer of rights to a logo or artwork. Submitting logos and artwork to us does NOT transfer the rights to us. 6. All users and purchasers of our services agree to indemnify and hold harmless fixlogo.com and website domain owners, affiliate websites and their respective owners and website domain owners, directors, officers, employees, agents, and related third party service providers, affiliates and entities from all liabilities, claims and expenses, including attorneys' fees, but not limited to, direct, indirect, special, incidental or consequential damages, or other losses arising from the use of the website, services or the use of, or inability to use, the products or services. By using fixlogo.com and services, you agree the entire liability of owners and any of their websites, including fixlogo.com and website domain owners, arising from or related to the use of our products, services and/or website(s) shall be limited to the amount actually paid by you for the products or services concerned. 7. If any term or provision of these Terms of Use is held to be invalid, void or unenforceable by a court or arbitrator of competent jurisdiction, the remainder of these Terms of Use will not be affected, impaired or invalidated and each remaining term or provision will be valid and enforceable to the fullest extent permitted by law. 8. Email finished art : Don't want to download your finished art from our website? For $5.00 extra, we will email your art to your registered email address. Your vector art will be in a regular Zip file that you can forward to your vendor or supplier. If you want to open the Zip file, you will need a program such as WinZip or Stuffit.
We do not charge extra for individual color separations if instructed when you submit art for production (separations are not available for CMYK 4 Color Process Logos).
PREMIUM VECTOR ART REDRAWING & CHANGES :
We will hand-redraw to duplicate the art you submit as sent into FixLogo true vector. We will only make changes that you request. We will make changes to your art as you request, usually at no extra charge. Art changes must be included in your instructions when your art is submitted for production. Common changes include : wording and phone numbers, color changes, reducing color quantity, size, layout, fixing design problems, eliminating halftones, etc. Most of these changes are included in our regular prices since we are already hand-redrawing your art. Therefore, the changes are usually easily done.

**Not all jobs can be done on a rush basis. Some jobs are too complex for us to hand-redraw within 1 day.
Our cut-off time for art jobs is 4:00 PM Pacific / 7:00 PM Eastern, weekdays. Artwork submitted after this time will not be downloaded, evaluated or placed into production until the following business day. We reserve the right to limit/decline quite complex jobs due to time restraints. We do not offer same day art service. Our terms apply to all jobs. Please see our terms for more info.
INFO REGARDING ARCHIVAL STORAGE OF ART
We do not archive the art we produce. Your art will remain available for you to download from our website for a maximum of 3 months. We believe in personal freedom and, therefore, personal responsibility. Whether you use our services or not, we strongly urge you to back-up and safeguard your art, as well as all other important images, documents, etc that you have on your computer.
Backing up is simple to do: External hard-drives and USB stick storage devices are very inexpensive. In addition, there are many free online services. Following is a short list of some of these services (an online search will produce many more). We neither endorse or recommend those shown below. Use at your own risk: please research and verify them for yourself.
